SUPERCHIP WARRANTY

Evidence of Cover

At the Superchip fit date a current original Warranty provided by the manufacturer of the motor vehicle is required for this guarantee to be operative and it is a Condition that such Warranty remains in force until its normal expiry date. This warranty applies only in the event and to the extent that the Manufacturer’s Warranty does not respond. The Superchip Warranty applies (subject to the Terms & Conditions as below) to damage directly caused to the relevant Motor Vehicle arising directly from Mechanical or Electrical Breakdown as summarised below by reason  of failure of the Superchip fitted by a Superchips Authorised Installer during the period of this Warranty

Summary of cover

Mechanical or Electrical Breakdown
Being the sudden and unforeseen failure of a component of the Motor Vehicle directly attributable to the operating of the Superchip the subject of this Warranty, which has caused the Motor Vehicle to stop working and therefore requiring repair or replacement before normal operation can be resumed.

Period: The Lesser Of:
a)  12 months from the date of  fitting of the Superchip to the Motor Vehicle by a Superchips Approved Installer or
b)  30,000 miles as measured on the Motor Vehicle odometer from the date of installation of the Superchip by a Superchips Approved Installer; or
c)  the period remaining on the original warranty provide by the manufacturer of the Motor Vehicle at the time of purchase from new whichever is the shorter

Conditions and Limits:
You should be aware that failure by you, the Customer to observe the manufacturers recommended maintenance procedures will invalidate any claim made. No sum in respect of economic or consequential loss is payable Use excludes competitions, track days, pacemaking, rallying and claims are subject to a limit of £10,000.00 in the aggregate in respect of any one vehicle. Normal deterioration or claims as a result of wear and tear are not covered.
Superchips cannot be held responsible for modifications to the vehicle which lead to defects.

SUPERCHIP WARRANTY TERMS & CONDITIONS

General Definitions

Limit of Liability
The liability of Superchips under this warranty shall not exceed the amount specified in Paragraph 4. Conditions and Limit of Warranty on the face of this warranty

Superchips
Superchips Limited (Incorporated in England & Wales -- Registration No 1303145 -- the Registered Office of which is at 2-16 Homestall Buckingham Industrial Park Buckingham MK 18 1XJ)

Customer
The owner of the Motor Vehicle to which a Superchip has been fitted, and who is domiciled within a member State of the European Union.

Superchip
A vehicle performance modifying computer chip fitted into or onto an Electronic Control Unit (ECU) or the installing of new software to an existing ECU by a Superchips Approved Installer that is designed to increase horsepower, torque and overall driveability.

Motor Vehicle
 A Motor Vehicle of UK taxation category B, B1, & B automatic the unladen weight  of which does not exceed 3500Kg and has not more than 8 passenger seats), to which a Superchip has been fitted

Approved Installer or Superchips Approved Installer
An approved fitting centre the personnel of which have been trained by Superchips and which is accredited by Superchips to fit a Superchip obtained from Superchips.

Mechanical or Electrical Breakdown
The sudden and unforeseen failure of a component of the Motor Vehicle directly attributable to the operating or fitting of the Superchip insured hereunder, causing the Motor Vehicle to stop working and therefore requiring repair or replacement before normal operation can be resumed providing the failed component was covered by the Motor Vehicle manufacturers warranty and declined by them due solely to the operating or fitting of the Superchip.

Normal deterioration or claims as a result of wear and tear are not covered.

Ggeneral Conditions

Claims Notification and Requirements
In the event of any occurrence giving rise, or likely to give rise to a claim hereunder, the Customer shall take precautions to prevent further damage to the Motor Vehicle. Superchips shall not be liable for any further damage resulting from the continued use of the Motor Vehicle.

The Customer shall provide a statement in writing of all particulars and details of the damage to the Motor Vehicle affected and the value thereof before any repair work is commenced. An Assessor may be appointed to investigate any claims hereunder.

The Customer shall furnish all such vouchers, proofs, explanations and other evidence as may be reasonably required by Superchips, together with a statutory declaration, if required, in verification of the statement.

Superchips may at its option repair, reinstate or replace or pay in money for any Mechanical or Electrical Breakdown covered by this insurance.

Superchips shall be entitled, at its discretion, and in the name of the Customer, to take over, defend or settle any claim and to take into consideration on any claim the improvement to any Motor Vehicle and due allowance shall be made for such improvement in settling the claim.

Precautions
The Customer shall ensure that:
(a)    all acts necessary to comply with any statutory obligations are observed by the Customer in respect of the Motor Vehicle to which the Superchip has been fitted.
(b)    the Motor Vehicle is maintained in accordance with the Manufacturer’s recognised standards.
(c)    all reasonable precautions are taken to prevent any Mechanical Breakdown to the Motor Vehicle.

Failure on the part of the Customer to comply with these conditions shall entitle Superchips to decline the claim risk(s)

Territorial Limits
This Insurance shall only apply to Mechanical or Electrical Breakdown occurring to vehicles within the United Kingdom of Great Britain and Northern Ireland but is extended to cover travel within other Member States of the European Union for up to thirty days in total during the period of cover under this Warranty

Access
Superchips or its representatives shall have the right at all reasonable times to have access to the Motor Vehicle.

Alteration or Modification
Any alteration to or modification to the Motor Vehicle before or after the fitting of the Superchip shall invalidate this warranty.

Subrogation
Superchips may, at any time, at its expense, use all legal means (including action at law) in the name of the Customer of securing reimbursement for the cost of Mechanical or Electrical Breakdown payable hereunder and the Customer shall give all reasonable assistance for that purpose.

Rights of Third Parties -- The Contracts (Rights of Third Parties) Act 1999
No person other than the Customer has any right (whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise) to enforce this Warranty-which accordingly is non transferable.

Observance
The due observance and fulfilment of the terms and conditions contained in this Warranty or endorsed hereon, insofar as they relate to anything to be done or complied with by the Customer, and the truth of the statements made by the Customer shall be conditions precedent to any liability of Superchips under this Warranty.

General Exclusions

Superchips shall not be liable for:

Preventative Maintenance
The cost of establishing preventative maintenance procedures or the cost of recall by the Manufacturers of the customers motor vehicle or any part thereof or the cost of alterations, additions, improvements or overhauls.

Consequential or Economic Loss
Loss of use of the Motor Vehicle, or any other consequential or economic loss, penalties for delay or detention, or in connection with guarantees of performance or efficiency other than the Mechanical Breakdown of the Motor Vehicle directly attributable to the fitment of the Superchip and where the cost of repair has been declined by the manufacturer.

Application of Tools, Extraneous Damage
Any Mechanical or Electrical Breakdown
(a)     caused by the application of any tool or process during the course of maintenance,   inspection, modification or overhaul
(b)     due to fire or any extraneous cause.

Wear and Tear
The cost of remedying or making good or loss solely due to:
(a)     wear and tear, gradual deterioration or rust
(b)     gradual developing defects, cracks or flaws that have no effect upon the continued operation of the Motor Vehicle.
(c)     scratching or chipping of painted or polished surfaces
(d)     gradual reduction in operating performance or any part where this can be reasonably considered to be due to wear, tear or deterioration commensurate with age, hours and condition of the Superchip.

Intentional Acts
Any Mechanical or Electrical Breakdown caused by:

(a)     intentional act or wilful neglect by the Customer.
(b)    i) intentional overloading of the Motor Vehicle
        ii) experiments involving the imposition of any abnormal conditions

Maintenance
Any Mechanical or Electrical Breakdown where the Motor Vehicle has not been serviced in accordance with the manufacturer’s recommended standards.

Other Insurance or Warranty
Any Mechanical or Electrical Breakdown which is claimable under the terms of any other Insurance, Warranty or Manufacturers Guarantee

Manufacturers Faults
Losses arising from faulty design or the subject of recall campaigns.

Modifications
Mechanical or Electrical Breakdown due to modification or alteration from the Motor Vehicles manufacturers standard specifications other than in respect of the Superchip.

Motor vehicle use
Where the Superchip has been installed in a Motor Vehicle that has been used for competitions, track days, pacemaking and / or rallies.

Existing Failures Faults or Defects
Costs arising from failures faults or defects reported during the PDI (Pre Delivery Inspection) which have not been repaired or replaced prior to the sale of the Superchip.

General Exclusions
Mechanical or Electrical Breakdown resulting from:

Improper use/application or abuse;
Environmental conditions;
Frost, corrosion, flooding, impact, fire, abuse, misuse or neglect, a defect which existed prior to the insurance taking effect, incorrect servicing or faulty repair.
Mechanical or Electrical Breakdown where:
The Motor Vehicle is not in possession of a valid MOT;
The Motor Vehicle is found to be unroadworthy.

Freight charges
Any freight charges in the event that a replacement part is not readily available...

Negligence and misuse
Any loss caused by negligence, misuse, alterations, lack of proper and necessary maintenance as prescribed by the manufacturers.

Local Legislation
Any cost incurred as a result of failure to meet current local legislation.
